Overview

This Privacy Policy explains how Capovani Brothers Inc. ("Capovani," "CBI," "we," "our," or "us") collects, uses, discloses, and safeguards information when you interact with our websites, applications, products, and related services, including capovani.com (collectively, the "Services").

Capovani is a reseller of used semiconductor, scientific, manufacturing, and laboratory equipment based in Scotia, New York, serving business and institutional customers worldwide. Our Services are directed to businesses and to individuals who are at least 18 years old.

Scope

This Policy applies to personal information we process as a controller (that is, where we determine how and why the information is used). Where we act as a service provider or processor on behalf of a customer, our handling of that information is governed by the underlying customer agreement.

This Policy covers individuals who interact with us in any capacity, including prospective and current buyers, individuals who request quotes, individuals who sell or offer to sell surplus equipment to us, vendors, and visitors to capovani.com.

This Policy does not apply to third-party websites, products, or services we do not control. CBI Surplus (cbisurplus.com), a separately branded division under common ownership, operates its own platform; information you provide directly to cbisurplus.com is handled under the privacy policy posted there.

Information We Collect

Information you provide to us

  • Account and contact details (name, business email, phone, password, company, job title, role).
  • Forms, messages, support inquiries, and order or quote details you submit.
  • Seller information, including equipment lists, descriptions, photographs, and contact details, when you offer assets for us to purchase.
  • Payment and billing details (collected and processed by our third-party payment providers; we do not store full card numbers).
  • Shipping, destination, end-use, and end-user information needed to fulfill orders and comply with export laws.
  • Any other content you upload or otherwise provide through the Services.

Information we collect automatically

  • Device and usage data (IP address, browser type, operating system, referring pages, pages viewed, search terms, and timestamps).
  • Cookies, pixel tags, and similar technologies used for security, preferences, and analytics. See Cookies & Tracking.

Information we receive from third parties

  • Identity, contact, or business information from partners, data-enrichment providers, or publicly available sources.
  • Payment and fraud-prevention signals from our payment processors.
  • Screening results from compliance and denied-party screening providers.

How We Use Information

We use personal information to:

  • Provide, operate, maintain, and improve the Services.
  • Process and fulfill orders, quotes, purchases of surplus equipment, and related requests.
  • Authenticate users and maintain the security, integrity, and availability of the Services.
  • Detect, investigate, and prevent fraud, abuse, and other harmful or unlawful activity.
  • Conduct export-control and trade-compliance screening (see Export Controls & Compliance Screening).
  • Analyze usage to improve performance, reliability, and user experience.
  • Communicate with you about your account, transactions, service updates, and—where permitted—marketing.
  • Comply with legal, tax, accounting, and regulatory obligations, and enforce our agreements.

How We Share Information

We share personal information only as described below. We do not share personal information with third parties for their own independent direct marketing without your consent.

  • Service providers and vendors that support our operations, including hosting and infrastructure, analytics, payment processing, email and communications, customer support, shipping carriers, and customs brokers. These providers are permitted to use the information only to provide services to us.
  • Compliance and screening providers for export-control and fraud-prevention purposes.
  • Professional advisors such as auditors, accountants, and legal counsel.
  • Business transfers — in connection with a merger, acquisition, financing, reorganization, or sale of assets, where recipients are expected to honor this Policy.
  • Legal and safety — to comply with applicable law, legal process, or governmental request, and to protect the rights, property, and safety of Capovani, our users, and others.
  • With your direction or consent.

Export Controls & Compliance Screening

Because we sell equipment internationally, we are subject to United States export control and trade sanctions laws. To comply, we may collect and process identity, company, destination, end-use, and end-user information and screen orders and parties against U.S. and other applicable government restricted- and denied-party lists. We may decline, delay, or cancel transactions where required by these laws.

Cookies & Tracking

We use cookies and similar technologies to:

  • Enable core functionality such as authentication and security (strictly necessary).
  • Remember your preferences (functional).
  • Measure and analyze usage and performance, including through analytics tools such as Google Analytics (analytics).

Strictly necessary cookies cannot be disabled. You can manage other cookies through your browser settings and, where offered, through our cookie banner or preference center. We honor recognized opt-out preference signals, including the Global Privacy Control (GPC), where required by applicable law. Because there is no common industry standard for "Do Not Track," we do not currently respond to DNT browser signals.

"Sale" and "Sharing" of Personal Information

We do not sell personal information in exchange for money. However, our use of certain analytics and advertising technologies may be considered a "sale" or "sharing" (for cross-context behavioral advertising) under some U.S. state privacy laws, including the California Consumer Privacy Act as amended (CCPA/CPRA).

You can opt out of this activity using the "Do Not Sell or Share My Personal Information" link in our website footer, by adjusting your cookie preferences, or by transmitting a Global Privacy Control (GPC) signal from your browser. We do not knowingly sell or share the personal information of individuals under 18.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, including to provide the Services, comply with legal, tax, accounting, export-control, and reporting obligations, resolve disputes, and enforce our agreements. Retention periods vary based on the type of information and the context in which it was collected. When information is no longer needed, we delete, anonymize, or securely store it.

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, and alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please keep your account credentials confidential and notify us promptly of any suspected unauthorized use.

International Data Transfers

We are based in the United States and may process and store information in the United States and other countries that may have different data protection laws than your country. Where we transfer personal data internationally—including from the EEA, UK, or Switzerland—we use appropriate safeguards, such as the European Commission's Standard Contractual Clauses, the UK International Data Transfer Addendum, or other lawful transfer mechanisms.

Your Privacy Rights & Choices

Depending on where you live, you may have some or all of the following rights regarding your personal information.

General choices

  • Marketing. You can opt out of marketing emails using the unsubscribe link in any marketing message.
  • Cookies. You can manage cookies through your browser or our preference controls, and transmit a GPC signal where supported.

EEA, UK, and Switzerland (GDPR)

You may have the right to access, correct, delete, or port your personal data; to restrict or object to certain processing; and to withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local data protection supervisory authority.

California (CCPA/CPRA)

Subject to legal limits, California residents have the right to:

  • Know and access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of recipients.
  • Delete personal information we have collected.
  • Correct inaccurate personal information.
  • Opt out of the "sale" or "sharing" of personal information.
  • Limit the use and disclosure of sensitive personal information (note: we do not use sensitive personal information for purposes that trigger this right).
  • Non-discrimination for exercising your rights.

In the preceding 12 months, we may have collected the following categories of personal information: identifiers; commercial information (orders, quotes, and transactions); internet and network activity; geolocation (general, derived from IP); professional or employment-related information; and inferences. We collect this information from the sources, and use and disclose it for the business purposes, described above.

You may use an authorized agent to submit requests on your behalf with proper authorization. We will verify your identity before fulfilling a request.

Other U.S. states

Residents of states with comprehensive privacy laws—including Virginia, Colorado, Connecticut, Utah, Texas, and others—may have rights to access, correct, delete, and obtain a copy of their personal data, and to opt out of targeted advertising and the sale of personal data. Where required, you also have the right to appeal a decision we make about your request; appeal instructions will be provided in our response.

How to exercise your rights

To exercise any of these rights, contact us at cbi@capovani.com or by mail at the address in Contact Us. We will respond within the timeframes required by applicable law. We may need to verify your identity before acting on a request, and we will not discriminate against you for exercising your rights.

Children's Privacy

Our Services are intended for businesses and for individuals who are at least 18 years old. We do not direct the Services to, and we do not knowingly collect personal information from, anyone under the age of 18. If you are under 18, please do not use the Services or submit any personal information.

If we learn that we have collected personal information from a person under 18, we will delete it promptly. If you believe a person under 18 has provided us with personal information, please contact us at cbi@capovani.com so we can remove it.

We do not use your personal information to make decisions that produce legal or similarly significant effects about you based solely on automated processing.

We may update this Policy from time to time. The "Last updated" date at the top reflects the most recent changes. We will post the updated Policy here and, where appropriate or required, notify you by email or within the Services. Your continued use of the Services after an update takes effect constitutes acceptance of the revised Policy.
